1. Acceptance of Terms
By accessing or using imgmend ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Description of Service
imgmend provides an AI-powered image noise removal service. Users may upload images in JPG, PNG, or WEBP format (up to 10 MB) to have noise, grain, and compression artifacts reduced using artificial intelligence.
3. Acceptable Use
You agree not to use the Service to:
- Upload images that are illegal, obscene, defamatory, or infringe any third-party rights
- Upload images containing sexually explicit content involving minors
- Attempt to reverse-engineer, overload, or disrupt the Service
- Use automated scripts to make bulk requests without prior written permission
- Resell or redistribute the Service without authorization
4. Intellectual Property
You retain full ownership of all images you upload. By uploading an image, you grant imgmend a limited, temporary license to process the image solely for the purpose of providing the Service. We do not claim any ownership over your content.
5. Free and Pro Plans
- Free plan: Processed images include a visible watermark. The Service is provided as-is with no guaranteed uptime.
- Pro plan ($4.99 one-time): Watermark-free downloads. Payment is non-refundable once the processed image has been downloaded.
6. Payments and Refunds
All payments are processed securely by Stripe. The Pro plan is a one-time purchase. Refunds may be issued at our discretion within 7 days of purchase if the processed image was unsatisfactory, provided you have not yet downloaded the watermark-free file. Contact us at support@imgmend.com for refund requests.
7. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee that the AI processing will meet your specific quality expectations. Results may vary depending on the input image.
8. Limitation of Liability
To the maximum extent permitted by law, imgmend shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data or images.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Modifications
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page. Continued use of the Service after changes constitutes your acceptance of the new Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region, without regard to its conflict of law provisions.
